What do you guys think about running a squad of 9 Kroot with a guard sergeant as a penal legion count-as? They would obviously be mercenaries and the "desperadoes" special rule could count as their mutations. I've been running a Kroot count-as Marbo for a while now, and it's been pretty sweet.

I think thats an extremly orignal and inventive idea. I'd go for it. Could also work if your were doing a gue'vesa themed army.

Great idea on how to include Kroot Mercenaries with Imperial forces.
Any special conversions you have in mind (lasguns, Guard kit), or are they just straight out of the box?

I would imagine that would be fine, so long as you made sure that your opponant knew exactly what they were before the game starts, i.e. before deployment.
You might have a bit of trouble with it at tournaments. If you are planning on using this army in a tournament, check with the organisers first and/or take alternative models on the day, as well as any confirmation letters/emails. Having organised a few myself I can tell you it is very easy to forget little agreements like this and having proof and an alternative helps smooth things over with those particularly troublesome players (and judges!)

There were rules for a Kroot Mercanary army in White Dwarf around about 3rd ed. It let imperial guard take kroot as Mercanaries, I think they're still legal
